Sundial Scheduling, LLC Terms of Service

These Terms of Service (“Terms”, “Agreement”) govern your use of the Sundial Chrome Extension and related services (“Services”) provided by Sundial Scheduling, LLC, a Delaware limited liability company (“Sundial”, “we”, “us”, or “our”). By installing and using the Sundial Chrome Extension or accessing our Services, you (“User”, “you”, or “your”) agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Sundial extension or services.

1. Services Provided

Sundial is a Chrome extension that enhances the functionality of Google Calendar by providing features that make the scheduling process more efficient.

2. Eligibility

You must be at least 18 years old to use the Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

3. Account and Registration

To use Sundial, you may be required to provide your email address and Chrome ID. You are responsible for maintaining the confidentiality of your email address and all activity that occurs under your user account.

4. Subscription Plans

Sundial offers both free and paid subscription plans, available to individuals and companies. For detailed information about available plans, please refer to our pricing page at https://trysundial.ai/pricing.

Multiple seat purchases are available for companies under the Business plan.

5. User Conduct

By using the Services, you agree not to:

  • - Violate any applicable local, state, national, or international law.
  • - Use the Services for any unlawful purpose or for any purpose prohibited by these Terms.
  • - Attempt to gain unauthorized access to any part of the Services or any system or network connected to Sundial.

6. Data Collection and Use

We collect data in accordance with our Privacy Policy (https://trysundial.ai/privacy), which is incorporated into these Terms by reference. We collect the following data from users:

Before Authentication: Your email address and Chrome ID to identify users.

During Usage: Information regarding your use of the Sundial extension, such as feature usage and frequency. This data is used solely to improve your experience with Sundial and enhance the performance of the extension.

Data Storage: We only store your email address, Chrome ID and usage-related events. Your data is never shared with third parties unless explicitly required for the functionality of our Services. Your data is never sold.

7. Third-Party Services

Sundial integrates with third-party services. You agree that your use of these third-party services is governed by their respective terms and policies, and we are not responsible for the practices or content of third-party services.

8. Intellectual Property

Sundial retains all rights, title, and interest in and to the Services, including all related intellectual property rights. You are granted a non-exclusive, non-transferable, revocable license to use the Services solely for personal or business use, subject to these Terms.

9. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in any activity that could damage the Services or other users. You may also terminate your account at any time by ceasing to use the Services and uninstalling the extension.

10. Disclaimers and Limitation of Liability

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.

Sundial does not guarantee the accuracy, completeness, or reliability of the Services, including any AI-generated information.

To the maximum extent permitted by applicable law, Sundial will not be liable for any damages arising from the use or inability to use the Services, including but not limited to incidental, indirect, or consequential damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sundial, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including attorney’s fees) arising from:

  • - Your use of the Services.
  • - Your violation of any of these Terms.
  • - Your violation of any applicable law.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the use of the Services shall be resolved through binding arbitration in Delaware.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website. Your continued use of the Services after any such modifications constitutes your acceptance of the new Terms.
